Title Curative

The work required to resolve gaps or defects in the recorded chain of ownership — missing probates, unrecorded deeds, name discrepancies, or old leases never released.

Why it matters when you sell

Curative is the work list standing between an interest and a clean sale, and most items on it are clerical rather than contested. What makes them costly is timing: addressed early they are routine, and addressed during a live transaction they cost leverage as well as money.

Example

A title review flags three items on a 240-acre position — a 1994 estate never completed in the county, a deed where a middle initial differs from the probate record, and a 1961 lease never formally released. All three are fixable with recorded documents. Resolved before marketing, they are invisible to buyers. Discovered mid-sale, they become the reason a closing date moves.

How this varies across the states we serve

What clears a defect differs across our launch states and sometimes between operators. Some accept a recorded affidavit only after a waiting period; some require an ancillary proceeding where the owner lived elsewhere. Operators also apply their own internal standards, so the same document can satisfy one company's division order department and not another's.

What to have in hand

Pull your county records and confirm every transfer in your chain was actually recorded. Gaps found now are a task; gaps found during diligence are a delay.
