Affidavit of Heirship
A sworn, recorded statement identifying the heirs of a deceased mineral owner, used where a formal probate was never completed in the county where the minerals lie.
Why it matters when you sell
Incomplete estates are the most common obstacle between an inherited interest and a clean sale, and they are usually cheaper to fix than owners expect. Families frequently probate the house and the accounts and never address minerals that were producing nothing at the time.
Example
A grandmother passes in 2003 owning minerals across two counties, and her estate is settled only in the county where she lived. Years later an operator completes a well and payment stops before it starts. Two long-standing family friends who stand to receive nothing sign sworn statements setting out the line of descent, and those are recorded where each tract sits. Handled that way the paperwork runs to a few hundred dollars; opening a separate proceeding in each county would have run to several thousand.
How this varies across the states we serve
How much weight an affidavit carries differs across the states we serve, and some give it full effect only after a waiting period has run from recording. Where a will exists, or where the heirs do not agree, a probate is generally required regardless. Operators also apply their own standards on top of state law, so an affidavit that satisfies one company's division order department may not immediately satisfy another's.
What to have in hand
Identify the people who could serve as witnesses while they are still able to. They must have known the family and take nothing under the affidavit, and that group only gets smaller — this is the most time-sensitive item in mineral estate planning.
