Royalty Interest

The right to a share of production revenue free of the cost of drilling and operating the well. It is the form of ownership most mineral owners hold and the form most buyers are looking to acquire.

Why it matters when you sell

A royalty interest is the most straightforwardly marketable thing in this asset class, because the buyer is acquiring income with no operating obligation attached. That simplicity is why royalty interests attract the widest pool of bidders — institutional funds, family offices and individual buyers can all underwrite one, where a working interest narrows the field considerably.

Example

A well grosses $560,000 in a month. Under a one-eighth royalty the royalty owners share $70,000 while the operating side divides the rest and pays every cost of running the well. In a month when operating expense exceeds revenue the royalty owners are still paid in full. A buyer values that asymmetry, and it shows up directly in the multiple offered.

How this varies across the states we serve

Royalty income is reduced by production and severance taxes before it reaches you, and those rates differ across the states we serve. Wyoming levies severance and ad valorem taxes on production but no state income tax; Texas applies severance at different rates for oil and gas and likewise has no income tax; Colorado, Oklahoma, New Mexico, North Dakota and Montana each apply their own combination. A buyer underwrites the after-tax stream, so two interests with identical gross production can support different bids purely on where they sit.

What to have in hand

Establish whether you hold a royalty interest or a working interest before marketing. If joint interest billings arrive rather than royalty cheques, the interest is a working one, and it is worth understanding how that changes the buyer pool before going out.
